1. Agreement
By accessing or using the Nursery Narketplace marketplace, you agree to these terms and the Privacy Policy. If you do not agree, do not use the service. Additional policies displayed during a transaction form part of these terms.
2. Marketplace role
The platform enables independent vendors to list nursery products and customers to place orders. Unless a listing expressly states otherwise, the identified vendor is responsible for its product description, lawful sale, quality, packing and fulfilment. The platform provides marketplace, payment-orchestration, support and operational services.
3. Accounts and acceptable use
You must provide accurate information, protect your credentials, and promptly report unauthorized access. You must not interfere with the service, probe security, scrape restricted data, impersonate another person, submit unlawful content, manipulate reviews, bypass marketplace fees, or misuse another participant’s information.
4. Listings, prices and orders
Product availability, delivery estimates and images may vary by vendor and growing conditions. Prices, taxes, shipping and discounts are shown before order confirmation. An order may be rejected or cancelled for stock errors, payment failure, suspected misuse, legal restrictions or an obvious pricing error, with eligible payments handled through the refund process.
5. Payments and delivery
Payments may be handled by configured third-party providers under their own terms. Delivery is performed by vendors or carriers and may be affected by location, weather, live-plant restrictions and events beyond reasonable control. Risk and title pass as provided by applicable law and the displayed delivery terms.
6. Vendor obligations
Vendors must maintain accurate identity, tax and payout information; list only lawful and available products; use truthful descriptions and images; maintain inventory; meet packing, plant-health and fulfilment obligations; protect customer data; handle returns; and comply with marketplace commission, settlement and service policies.
7. Cancellations, returns and refunds
Eligibility depends on the product, condition, timing, order state and applicable consumer law. Live plants and perishable items may require prompt photographic evidence. Nothing in these terms limits non-waivable consumer rights. Approved refunds are sent through the applicable payment process and may require provider processing time.
8. Reviews and content
You retain ownership of content you submit but grant the operator a non-exclusive licence to host, display and use it for marketplace operation and promotion. Content must be accurate, lawful and respectful. We may moderate content that violates policy or law.
9. Intellectual property
The platform software, design, documentation, trademarks and original content are protected by applicable intellectual-property laws. Access does not grant a right to copy, reverse engineer, reproduce or commercially exploit protected platform materials.
10. Availability and liability
We work to keep the service reliable but cannot promise uninterrupted availability. To the extent permitted by law, neither the operator nor vendors are liable for indirect or consequential loss. No provision excludes liability that cannot legally be excluded, including applicable consumer protections.
11. Suspension and termination
Access may be restricted or terminated for security risks, fraud, legal requirements, repeated policy breaches or harm to marketplace participants. Obligations relating to completed transactions, fees, disputes, confidentiality and intellectual property survive where applicable.
12. Governing law and disputes
These terms are governed by the laws applicable in India, subject to mandatory consumer rights. Parties should first attempt good-faith resolution through support. Courts with jurisdiction over the operator’s registered office will apply unless applicable law requires another forum.
